Chapter 41 amends Retirement and Social Security Law Section 1000 by removing existing requirements for military service to be performed during specified periods of war and certain hostilities. Eligible members may claim up to three years of service credit for military duty. A member must be honorably discharged from the military, have at least five years of credited service, be an active NYSTRS member on or after May 31, 2016 (the date the law took effect) and claim any possible military credit before the effective date of retirement in order to be eligible. The cost for Tier 1, 2, 3, 4 and 5 members is 3% of salary earned during the 12 months of credited service immediately preceding the year in which a claim is made for each year of military service. The cost for Tier 6 members is 6% of salary earned during the 12 months of credited service immediately preceding the year in which a claim is made for each year of military service.
